AMERICAN OUTRAGE: Bergdahl Attorney Indicates No Jail Time, Slap On The Wrist Awaiting Deserter In “Misdemeanor Court”
It helps to have friends in high places, illegitimate as they might be, and when you’re a criminal deserter, it’s best if your friends are equally despicable. Sgt Bowe Bergdahl has those kinds of friends. He’s got a kindred America-hating spirit in the White House.
According to a report in the Associated Press, the Army may now be willing to let bygones be bygones and treat Bowe Bergdahl’s desertion as something more along the lines of a first offense drunk driving conviction, choosing to ignore the collusion with the enemy and associated deaths among those who went looking for him following his desertion.
The report cites a statement by Bergdahl defense attorney, Eugene Fidell, who said that Lt Col Mark Visger has decided to send the Bergdahl case to a military system that is similar to civilian courts which handle misdemeanor cases.
The maximum penalties are much lower, consisting of a potential for a reduction of his already improperly raised rank, a bad conduct discharge and possibly a short jail term, although they are reportedly not going to be seeking any incarceration. This would represent a major reduction in the potential penalties which, under his current charges of desertion and misbehavior before the enemy, carry the potential of life in prison.
Paul Boyce, a spokesman for the U.S. Army’s Force Command, neither confirmed or denied the attorney’s comments, issuing a largely non-substantive statement on Saturday, which read in part, “As legal action is ongoing, we continue to maintain careful respect for the military-judicial process, the rights of the accused, and ensuring the case’s fairness and impartiality.”
Visger presided over a September Article 32 hearing in Texas reviewing the evidence against Bergdahl. He submitted his report with his recommendation on Monday, with no indication from the Army of its contents.
